Aviation Disputes

Disputes in the aviation industry can arise at any stage of an aircraft's life cycle — from a breach of an aircraft purchase agreement, to a disagreement between lessor and lessee under an aircraft lease, to a falling-out with an aircraft management company, a default under an aircraft financing agreement, or a dispute over engine maintenance or warranty obligations. Aviation litigation can feel overwhelming, particularly given the technical complexity and high value typically involved. Atasoy Law Firm (the "Firm") offers aviation litigation services to aircraft owners, operators, and businesses navigating these disputes.

Aircraft Purchase Agreement Disputes
Aircraft purchase disputes often involve disagreements over pre-purchase inspections, airworthiness representations, title and lien issues, or delivery conditions that were not met. These disputes hinge heavily on technical records and maintenance history, and resolving them early — through negotiation where possible — can avoid the cost and delay of a drawn-out claim.

Aircraft Lease Agreement Disputes
Lease disputes commonly arise over return condition obligations, maintenance reserve calculations, redelivery inspections, or alleged defaults during the lease term. These claims typically turn on the specific obligations set out in the lease and on prevailing aviation industry standards for aircraft condition and maintenance.

Aircraft Management Agreement Disputes
Disputes between owners and management companies often turn on the scope of delegated authority, handling of operating costs, or compliance with regulatory and maintenance obligations. Flight logs, maintenance records, and financial reporting are usually central to establishing what was agreed to and whether it was followed.

Aircraft Financing Agreement Disputes
Financing disputes frequently involve alleged defaults, disputes over collateral and security interests in the aircraft, or disagreements over loan or mortgage terms tied to the aircraft's value and use.

Aircraft Engine Disputes
Engine disputes often center on warranty claims, maintenance program compliance, or disagreements over the condition of an engine at the time of return or sale. Even after a judgment is obtained, recovering what is owed can require further steps, particularly where the responding party's assets are not easily reached.

Engine Lease Agreement Disputes

Engine leasing raises its own set of issues, distinct from whole-aircraft leases, given that engines are frequently swapped between airframes, pooled across fleets, or leased separately from the aircraft they power. Disputes in this area often involve disagreements over engine utilization and cycle reporting, responsibility for shop visits and overhaul costs, the condition of an engine at redelivery, or competing claims where an engine has been installed on an airframe other than the one originally contemplated by the lease.

Cape Town Convention and International Registry Disputes
Many disputes involving aircraft, engines, and airframes are shaped by the Cape Town Convention on International Interests in Mobile Equipment and its Aircraft Protocol, which governs the creation, priority, and enforcement of international interests registered against airframes, aircraft engines, and helicopters. Disputes in this area often involve priority contests between competing registered interests, the validity or discharge of a registration on the International Registry, or the exercise of default remedies — such as repossession or deregistration — available to creditors under the Convention.
